Project Noah Nature Curriculum: Teacher, School & District Terms of Use

Thank you for purchasing Project Noah Nature School Curriculum! (“NSC”). NSC is intended for educational and/or personal use only. By purchasing the NSC, you agree and are bound to the following terms and policies. Project Noah’s terms and policies are subject to change without notice and you agree to any subsequent changes by use or continued use of the NSC.

The NSC contains copyright and trademark works and All Rights Are Reserved by Project Noah Publishers LLC d/b/a Project Noah Nature School:

• No Materials may be used, published or re-published, downloaded, copied or distributed for commercial purposes or for any use other than educational and personal, and may not be displayed or performed for public view, altered, modified, deleted, or extracted from text.
• NSC content and materials are intended for use as supplemental environmental educational resources for science teachers. NSC content and materials are not presently meant to replace a core curriculum. NSC content is meant for teachers and educator use – not for individual student log in.
• Payment for NSC content and materials provide teacher / purchasers with a license to use the full curriculum for all of the teacher / purchaser’s students.  Teacher / Purchaser may not distribute premium NSC content and materials in any form including but not limited to online, print, digital or otherwise.  Teacher / Purchaser may not share NSC content and materials with other non-purchasing teachers.  Each Teacher / Purchaser shall require a paid license to access and use NSC materials and content.
• A key component of NSC content and materials are suggested outdoor student learning activities or ideas about engaging with nature.  Project Noah limits its liabilities as detailed in the Limit of Liabilities section below. Students and minors must always be supervised by a responsible adult for all outdoor activities at all times. Each teacher/purchaser is solely responsible for obtaining any and all necessary permissions and assumptions of risk waiver or any other waiver from each participant / student.
• Project Noah Nature School’s system goes out of its way to not collect personally identifiable information from students. We do not collect personal information from students to protect their privacy. Our system interfaces with teachers, schools and district staff. It does not provide a mechanism for student access and does not recommend student access our subscription portal.
• TEACHERS AND STUDENTS SHOULD NEVER APPROACH OR ATTEMPT TO HANDLE WILDLIFE AT ANY TIME. ALL STUDENTS REQUIRE ADULT TEACHER SUPERVISION AT ALL TIMES. Ms. Mallory is an educated and trained wildlife professional.

Nothing contained herein shall be construed or constructed as conferring by implication, estoppel, or otherwise any license or right to any Project Noah’s or any third party’s copyright and/or trademark that may appear. Unless expressly granted, all rights are reserved to Project Noah Publishers LLC  d/b/a Project Noah Nature School. To request permission from Project Noah for any other use, please contact support@projectnoah.org.

LIMITATION OF LIABILITY. NATURE SCHOOL CURRICULUM (“NSC”) CONTENT ARE AVAILABLE “AS IS.”  PROJECT NOAH PUBLISHERS LLC d/b/a PROJECT NOAH & PROJECT NOAH NATURE SCHOOL (“PROJECT NOAH”) MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITS CIRRICULA, OUTDOOR STUDENT LEARNING ACTIVITIES SUGGESTIONS AND IDEAS, MEDIA, OR ANY PART THEREOF, INCLUDING ANY WARRANTIES OF TITLE, NON-INFRINGEMENT OF COPYRIGHT, TRADEMARK OR PATENT RIGHTS OF OTHERS, MERCHANTABILITY, OR FITNESS OR SUITABILITY FOR ANY PURPOSE OR USE.  IN NO EVENT WILL PROJECT NOAH, ITS DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES OR AFFILIATES BE LIABLE FOR LOST PROFITS OR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND, HOWSOEVER CAUSED, ARISING FROM THE USE OR INABILITY TO USE PROJECT NOAH NATURE SCHOOL’s CURRICULA, WEBSITE(S), TEACHER PORTAL, SUBDOMAINS, MEDIA, AND THE TERMS OF USE,  OR RELATING TO THE OBLIGATIONS HEREUNDER; PROVIDED THAT THE FOREGOING LIMITATION ON LIABILITY SHALL NOT APPLY TO GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF PROJECT NOAH AND ITS EMPLOYEES.

Any term that does not expressly appear for the NSC, the General Terms of Use for Project Noah’s website shall control.
